040 Cancelación de Endoso

What is it?​

  • It is the document that evidences the declaration of cancellation of an electronic endorsement on an Electronic Sales Invoice as a Bill of Exchange.
  • It allows the cancellation of the "Endoso en Garantía" or "en Procuración."

Who is responsible for generating the electronic document?​

  • The Issuer, Biller, or its Legitimate Holder is responsible for making the registration.

Who is responsible for receiving the electronic document?​

  • The Endorsee is responsible.
Restrictions
  • Applies only for "endosos en garantía" and "en procuración": the "endoso en garantía" could be revoked by the creditor who receives the title as guarantee when their credit has been satisfied; and on the other hand, the "Cancelación del endoso en procuración" could apply when the legitimate holder of the title seeks to withdraw the powers of the endorsement for collection that had been entrusted to a third party.
  • The "Cancelación del endoso en garantía" can be generated when the guaranteed obligation has been paid.
  • The "Cancelación del endoso en procuración" can be generated when the presentation for acceptance, collection, or judicial execution of an Electronic Sales Invoice is not necessary.
  • The “Limitation for circulation of the electronic sales invoice as a bill of exchange” restricts the generation of this event.
  • The “Protesto” restricts the generation of this event.
  • The "Terminación del mandato" restricts the generation of this event by the attorney.
